Health & Safety and Regulatory Crime
From Asbestos to young persons, today there are regulations in respect of almost every aspect of running a business or any form of non domestic employment whatever the size.
dgb Solicitors Health & Safety and Regulatory Crime Team consists of two partners Chris Simpson and Ian Pentecost. Chris deals principally with prosecutions brought in relation to Health & Safety issues by the Health & Safety Executive (HSE) or Local Authority. The HSE will bring prosecutions in respect of offences that have taken place in factories, mines and quarries, other industrial processes, docks, offshore fishing and railways. The Local Authority will bring prosecutions arising out of the offences occurring in shops, offices, warehouses, schools and colleges, hospitals and recreational establishments. In extreme cases involving gross negligence manslaughter prosecutions will be brought by the Crown Prosecution Service.
Ian Pentecost has experience in the defence of prosecutions brought by the Environment Agency in relation to allegations of breach of waste management licence's and offences such as the unlawful transfer, tipping or storage of controlled waste.
dgb can advise and assist from the point at which you are first approached in an investigation through to representing you before the Magistrates' Court in the event that a prosecution is brought. In the event that the prosecution proceeds to a higher Court dgb can make all the necessary arrangements for you to be represented by appropriate Counsel. |
